DMCA Policy

Qygigoo respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how Qygigoo responds to claims of copyright infringement and how you may submit a notice if you believe content on our platform infringes your copyright.
1. Notification of Claimed Infringement
If you believe that content available on or through our platform infringes one or more of your copyrights, please submit a written notice ("DMCA Notice") containing the following information to our designated copyright agent:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our platform.
- Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

We recommend submitting your notice via email to ensure the fastest possible response.
3. Counter-Notification Procedure
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. To be effective, a counter-notification must be a written communication that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of a competent court and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not notify us within ten (10) business days that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may, at our discretion, restore the removed material.
4. Repeat Infringer Policy
Qygigoo maintains a strict policy regarding repeat infringers. In appropriate circumstances, we will terminate the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights. We reserve the right to make this determination at our sole discretion.
5. Misrepresentation
Please be aware that submitting a DMCA Notice or counter-notification that contains materially false or misleading information may result in civil liability. Before submitting a notice or counter-notification, you should carefully consider whether the use of the material in question constitutes infringement or whether an exception or limitation to copyright applies.
6. Modifications to Removed Content
We reserve the right to modify or remove content that is the subject of a DMCA Notice at our sole discretion, even in the absence of a formal legal obligation to do so. Removal of content in response to a DMCA Notice does not constitute an admission of wrongdoing or liability on our part or on the part of any user.
7. Good Faith and Abuse Prevention
Our DMCA process is intended to protect legitimate intellectual property rights. We will not process notices that are incomplete, clearly frivolous, or submitted in bad faith. We reserve the right to seek damages from any party who abuses this process.
8. License and Fair Use
This policy does not limit your ability to exercise rights granted under applicable copyright law, including fair use, fair dealing, or other recognized exceptions and limitations to copyright. If you believe your use of copyrighted material is protected by such an exception, you should consider this before submitting or responding to a DMCA Notice.
9. Changes to This Policy
We reserve the right to update or modify this DMCA Policy at any time. Any changes will be effective upon posting the revised policy to our platform. Your continued use of our platform following the posting of any changes constitutes your acceptance of those changes. We encourage you to review this policy periodically.
